TomoCam Terms of Service
These terms govern your use of the TomoCam app and website. Please read section 4 and section 6 carefully.
1. Agreement
By creating an account or using TomoCam you agree to these terms. If you do not agree, do not use the service. TomoCam is provided by edge-manager.com.
2. What TomoCam is
TomoCam lets you use devices you already own as cameras and view them from your own other devices. We provide the software and the connection service that lets your devices find and reach each other. You provide the devices, the network, and the power.
3. Your account
You are responsible for keeping access to your account secure and for activity that happens under it. You must provide accurate information and be old enough to form a binding contract where you live.
4. Acceptable use
You are responsible for where you point a camera. You may only use TomoCam to monitor spaces you own or control, or where you otherwise have the legal right to record.
- Do not use TomoCam to record people who have not consented where their consent is required by law.
- Do not place cameras where people have a reasonable expectation of privacy, such as bathrooms or changing areas.
- Do not use TomoCam to harass, stalk, or intimidate anyone.
- Do not attempt to access devices or accounts that are not yours, or to interfere with the service.
Local law on recording, and on recording audio in particular, varies and can be stricter than you expect. Complying with it is your responsibility, not ours.
5. Your content
Anything your cameras capture belongs to you. We claim no ownership of it, and because we do not store it on our servers, we could not use it even if we wanted to.
6. TomoCam is not a security or life-safety system
TomoCam is a convenience tool. It depends on your devices staying powered, your network staying up, and our connection service being reachable — none of which is guaranteed.
Do not rely on TomoCam for the protection of life, health, or property. It is not a monitored alarm system, not a medical device, and not a substitute for one. If you need guaranteed monitoring, use a service that offers it with a corresponding guarantee.
7. Availability and changes
We may change, suspend, or discontinue parts of the service. Where a change materially reduces what the service does, we will give notice in the app where we reasonably can.
8. Fees
TomoCam is currently provided free of charge. If we introduce paid features, we will say clearly what is paid and what stays free before you are asked to pay anything.
9. Termination
You may stop using TomoCam and delete your account at any time. We may suspend or terminate an account that breaches these terms, in particular section 4.
10. Disclaimer and limitation of liability
The service is provided "as is" and "as available", without warranties of any kind to the fullest extent the law allows.
To the fullest extent permitted by law, we are not liable for indirect or consequential loss, for loss of data, or for loss arising from the service being unavailable or from a camera failing to capture an event. Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for our own intentional misconduct or gross negligence, and nothing here limits rights you have as a consumer that cannot be waived.
11. Governing law
These terms are governed by the laws of Japan. Where you are a consumer, this does not deprive you of the protection of mandatory rules of the country where you live.
